  • Illegal purposes
  • Harassment or abuse
  • Impersonation or misleading communication

4. AI & Automation Disclaimer

Our system uses automated AI voice technology. Responses may not always be accurate, complete, or appropriate. You are solely responsible for how the system is used in your business.

5. Call Recording & Legal Compliance

Our system may record and store calls and voice interactions.

You are responsible for complying with all applicable laws, including two-party consent laws such as those in the State of Florida. You must obtain proper consent from callers when required.

6. No Guarantee of Results

We do not guarantee any specific results, including increased revenue, leads, or business performance.

7. Service Availability

Services may be affected by technical issues or third-party providers. We do not guarantee uninterrupted or error-free operation.

8. Payments

All fees are due as agreed. Failure to pay may result in suspension or termination of services.

9. Data & Storage

We may store call recordings, transcripts, and interaction data for service operation, compliance, and improvement.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages.

11. Indemnification

You agree to defend, indemnify, and hold harmless our company from any claims, damages, or legal actions arising from:

  • Your use of the service
  • Violation of laws or regulations
  • Failure to obtain required call recording consent

12. Termination

We reserve the right to suspend or terminate services at any time for misuse, non-payment, or violation of these terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Florida.

14. Dispute Resolution

Any disputes shall first be attempted to be resolved informally. If unresolved, disputes may be handled through binding arbitration in Florida.

15. Changes

We may update these Terms at any time. Continued use of the service constitutes acceptance of changes.

16. Prohibited Interaction & Abuse

Users may not engage in abusive, offensive, inappropriate, or sexually explicit interactions with the system.

We reserve the right to monitor interactions and restrict or terminate access if misuse is detected.

The system is designed for legitimate business communication only and may limit or terminate conversations that fall outside of appropriate use.

17. Usage-Based Billing & Third-Party Costs

Our services may be billed based on usage, including but not limited to voice minutes, call duration, and system interactions.

These usage costs are influenced by customer activity, call volume, and interaction length, which are outside of our direct control.

By using our services, you acknowledge and agree that:

  • Charges may vary based on actual usage
  • We are not responsible for increased usage caused by customer behavior
  • All usage-based charges are the responsibility of the client

We reserve the right to adjust pricing if third-party service providers change their rates or pricing structures.

18. Call Transfers & Ongoing Billable Time

All call time is billable from the moment a call begins until the call is fully disconnected.

This includes time before, during, and after any call transfer.

19. Data Retention: Recordings & Transcripts

Call recordings and transcripts are stored for a limited period of up to 30 days.

After this period, data may be automatically deleted and may not be recoverable.

Clients are responsible for saving or exporting any recordings or transcripts they wish to retain beyond this period.

We are not responsible for the loss of data after the retention period has expired.

When a call is transferred to a live person or external number, the system remains active and connected. As a result, all time during the transfer and any connected duration continues to count toward usage-based billing.

By using the service, you acknowledge and agree that:

  • Call minutes continue during transfers
  • Transferred calls are not paused or excluded from billing
  • All connected call time is counted toward total usage

All usage-related charges are the responsibility of the client.
